All GOODS AND SERVICES BY NO NONSENSE FIRE & ESSENTIAL SERVICES PTY LTD ("NNF") ARE SUPPLIED ON THESE TERMS AND CONDITIONS



NNF OBLIGATIONS

NNF warrants that:

(a)        Goods supplied will be fit for the purpose for which they are intended;

(b)        Services will be performed in a good and workmanlike manner; and 

(c)        it will at all times exercise due skill, care and diligence in the provision of the Goods and/or Services.


INVOICING AND PAYMENT


(a) Following each service, a Tax Invoice will be issued for the goods and services, and any testing carried out at the time of service. All invoices are due and payable by the due date stated on the invoice, which is 7 days from the Invoice Date. All prices quoted are GST exclusive.

(b) Late Payment Fees may be charged on any overdue invoices.

(c) Where a Customer’s account remains in arrears for three consecutive months, the Customer grants to NNF a licence to enter at any time on and into any premises occupied, owned or managed by the Customer to inspect, search for or remove any of the Goods which remain unpaid

(d) NNF reserves the right to increase the pricing of the Maintenance Agreement at any time in accordance with Consumer Pricing Index (CPI), without prior notice to the client. Such increases are limited to once per year and will not be applied during the initial year of service.

(e) Non-payment or overdue payments may result in the suspension of services to the property until payments are up to date or the cancellation of services altogether.

 

CANCELLATION


(a)        NNF or the Customer may terminate the services of NNF by giving the other party one months’ written notice.  

(b)     The Customer will be liable for any charges incurred up until that date.  Where the Customer’s account is in arrears, the Customer grants to NNF a licence to enter at any time on and into any premises occupied, owned or managed by the Customer to inspect, search for or remove any of the Goods which remain unpaid.  


OWNERSHIP


(a)      Ownership in any Goods supplied does not pass to the Customer until the Customer has discharged all outstanding indebtedness, whether in respect of the Goods or otherwise, to NNF.  

(b)        Delivery may not be refused by the Customer once an order has been placed. 


JURISDICTION

The Contract is governed by and to be construed in accordance with the laws of Victoria.
